Value Added Tax (“VAT”) has been applicable to certain taxable persons in the UAE

Value Added Tax (“VAT”) has been applicable to certain taxable persons in the UAE since 1 January 2018. A taxable person is defined under ‘Federal Decree-Law No. (8) of 2017 on Value Added Tax’ (the “Decree Law”) as any natural or legal person registered or obligated to register for tax purposes. Due to VAT’s relatively short history in the UAE, there remains some uncertainty around a taxable person’s obligations in terms of the Decree Law and other relevant regulations. Clout is currently advising a large corporate client regarding a VAT dispute with the Federal Tax Authority for an amount of AED150 million. Our goal as legal advisors is to minimize the VAT liability of our client while working within the framework of the Decree Law and the relevant VAT regulations.
